What is needed for a valid Nikah?
For an Islamic marriage to be recognized as valid (Sahih) under Shariah law, the following core pillars must be met during your ceremony:
- Mutual Consent (Ijab and Qabul): A clear proposal from one side and acceptance from the other, performed in the same sitting.
- The Wali (Guardian): The bride must be represented by her Wali (typically her father, grandfather, or brother). If the Wali is overseas, special authorization (Wakalah) can be arranged.
- Two Muslim Witnesses: The presence of at least two sane, adult, male Muslim witnesses.
- The Mahr (Dowry): A mandatory gift given by the groom to the bride. This is her exclusive property.
The Hong Kong Civil Process
A religious Nikah ceremony alone does not constitute a legally recognized civil marriage in Hong Kong. You must follow the civil process:
- The 15-Day Rule: By law, the civil marriage cannot take place until at least 15 days after your Notice is filed.
- Two Pathways: Have your civil marriage at the Registry and the Nikah at the Masjid separately, OR hire a Muslim Civil Celebrant for a joint ceremony.
