What is the difference between an Islamic Will (Wasiyyah) and Faraid?
An Islamic Will (Wasiyyah) allows you to dictate the distribution of up to one-third (1/3) of your estate to non-heirs or charities. Faraid is the mandatory Islamic law that dictates exactly how the remaining two-thirds (2/3) must be divided among your legal, surviving family members.
Who actually qualifies as an heir under Faraid?
Primary heirs always include the surviving spouse, children, and parents. In certain circumstances, if primary heirs are not present, siblings and grandparents may inherit. The exact fractional shares shift entirely depending on the specific combination of surviving relatives.
What if some family members are non-Muslim?
Under classical Shariah law, non-Muslim relatives do not automatically inherit via the Faraid system. However, you are absolutely permitted to provide for them financially through the Wasiyyah (the discretionary one-third of your estate) in your Islamic Will. We can advise you on how to structure this legally.
